These terms of use (“Terms”) govern your use of the Amigocci website and all related services provided by Amigocci (“Services”). By accessing or using the Services, you agree to be bound by these Terms.

Your Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the United States or other countries).

  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.

  • To impersonate or attempt to impersonate Amigocci, a Amigocci employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).

  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by Amigocci, may harm Amigocci or users of the Services or expose them to liability.

User Content

The Services may allow you to upload or submit content (“User Content”). You retain all rights in, and are solely responsible for, the User Content you submit. By submitting User Content, you grant Amigocci a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and Amigocci’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases that are necessary to grant to Amigocci the rights in such User Content, as contemplated under these Terms; and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor Amigocci’s use of the User Content as permitted herein will infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Intellectual Property Rights

The Services and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Amigocci, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

  • You may store files that are automatically cached by your Web browser for display enhancement purposes

Disclaimer of Warranties

The services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Neither Amigocci nor any person associated with Amigocci makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither Amigocci nor anyone associated with Amigocci represents or warrants that the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that our services or the server that makes them available are free of viruses or other harmful components, or that the services will otherwise meet your needs or expectations.

Limitation of Liability

In no event will Amigocci, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the services, any websites linked to it, any content on the services or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

Indemnification

You agree to defend, indemnify, and hold harmless Amigocci, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Services’ content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

Governing Law and Jurisdiction

Under German law, choice of law clauses in contracts are generally enforceable only if they meet certain requirements, such as being freely negotiated and not being contrary to mandatory provisions of German law. Depending on the specific circumstances, a German court may find that the choice of law clause in your terms and conditions is invalid or unenforceable.

Trial Period Terms and Conditions

After the trial period ends, you will be automatically enrolled in our paid subscription service, unless you cancel before the end of the trial period.

There are no fees associated with the trial period. However, if you choose to continue using our application after the trial period ends, you will be charged a subscription fee, plus any applicable taxes.

You may cancel the trial period at any time before the end of the trial period by following the instructions provided in our application or by contacting our customer service team. If you cancel before the end of the trial period, you will not be charged any fees.

Data Collection and Use We collect and use your personal data in accordance with our Privacy Policy, which is available on our website. 

By signing up for the trial period, you consent to our collection and use of your personal data as described in our Privacy Policy.

Limitations and Restrictions During the trial period, certain features of our application may be limited or unavailable. We reserve the right to modify, suspend, or terminate the trial period at any time without prior notice.

Changes to these Terms

Amigocci reserves the right to modify these Terms at any time in its sole discretion, and such modifications will be effective immediately upon posting on the Services. Your continued use of the Services after the posting of revised Terms means that you accept and agree to the changes.
